Klimatherm BV Netherlands (ClimaTherm), Capelle aan den IJssel

In June 2022 i made an agreement with a company called Klimatherm BV Netherlands for the installation of a complete heat pump system. I was made an offer, agreed an installation date for 27th August and payed 5000 euros advance money for this offer. No heat loss survey was performed, no other measurements taken except a site visit by the owner. Sometime in August 2022, Klimatherm, through their representative and owner informed me they are having delivery problems and that installation will be postponed for September. I agreed to wait. After failing to provide a install date, throughout October, November, December, in January they finally promised to install . We agreed on a final deadline on 16th of February when they promised to install or refund. Install did not happen and neither refund. On the 20th of February after their failing to start installing on the final term (they had promised 16th of Feb) i have informed Klimatherm that i am exercising my consumer right to cancel our agreement, as per my rights described here https://www.acm.nl/levering I have given them until the end of the business day to arrange the refund. They have refused and have stated that they intend to deliver the heat pump. I have declined and insisted for a refund. They did not provide a refund. At this point the nightmare started. The started threatening me with lawyers that would enforce delivery on me. I was put in contact with their law firm to which I explained the situation. I also clarified that as advised by my bank I had opened a police case. Finally their lawyers replied with a promise to pay the refund in maximum 2 weeks time. I agreed to remove my police report. Finally the 2 weeks passed and no payment was made. The owner as a representative of Klimatherm, ignored his lawyers, and continued to lie about various problems that was preventing them to refund. In the end i have posted negative reviews on their google page. This apparently made him very mad. So mad that he threatened to come to my door, although no more interaction was expected from Klimatherm, except a refund. I also reopened the police case. When I refused to remove my posts on Google I also started receiving unknown number calls during the night. I opened a separate police case about harassment. Their conclusion was that threats are not enough for them to do anything at this point. At some point in March I also tried to get my money back though an incasso company. They ignored all of their messages to pay. More recently the Google reviews started to bite according to messages from the owner. The owner started sending messages that I am killing his business with my Google reviews. Again he started to make all kinds of promises to pay if I only removed my reviews. I said I would remove my reviews if he paid the refundn in full He also tried to convince me he was going to pay, only because he chose so, as my order was a custom product not eligible for a cancellation according to him. In the meantime (around 2nd of June 2023) he confirmed in writing the product was sold further to another client, in effect contradicting the custom item claim. The products were also off the shelf products. In the background this started to take a toll on my family. The stress, on both me and my wife started to cause sleepless nights for both of us. We are now both seeking professional help to cope with this. Recently (last week of June 2023) the company made 2 payments totally 1000 euros. But failed to provide any plan for a full refund. I am now faced with going to court. Which finally seems that only solution to have a chance to see the whole refund payed to me. Quite annoying to have to do this for 3000 Euros. Also the owner, after having received a final deadline to pay in full on the July 5th, said that he will sue me because of the damages caused by my Google reviews. This is causing further stress to me any my family.
